COURSE ENROLMENT TERMS AND CONDITIONS

These Terms and Conditions govern enrolment onto any course, workshop, certification programme, mentoring programme or continuing professional development (CPD) activity delivered by Equilibrium Pilates Education Limited ("the Company", "we", "us", "our").

By enrolling on a course, you ("the Learner") confirm that you have read, understood and agree to these Terms and Conditions.

  1. ENROLMENT
1.1 Your place on a course is secured when either:
• Full payment has been received; or
• The stated non-refundable deposit has been paid and an agreed payment plan has been established.
1.2 Enrolment is subject to availability and confirmation from the Company.
1.3 The Company reserves the right to refuse enrolment where prerequisites have not been met or where enrolment is considered unsuitable for the course.

  1. COURSE FEES AND PAYMENT OPTIONS
2.1 Course fees are displayed on the relevant course information page and/or provided during the enrolment process.
2.2 Where a payment plan is offered, this typically consists of:
• A non-refundable deposit
• Monthly instalments; or
• A deferred balance payment arrangement
2.3 Payment plans are provided solely as a method of spreading the cost of the course and do not constitute a subscription service.

  1. PAYMENT COMMITMENT
3.1 By enrolling on a course, you agree to pay the full course fee regardless of:• Attendance levels
• Course completion
• Withdrawal from the course
• Changes in personal circumstances
3.2 Acceptance onto the course creates a contractual commitment for the full course fee.

  1. PAYMENT SCHEDULE
4.1 Instalment dates and amounts will be confirmed at the point of enrolment.
4.2 Payments will normally be collected on a fixed monthly date.
4.3 It is the Learner's responsibility to ensure sufficient funds are available and payment details remain valid throughout the duration of the course.

  1. MISSED PAYMENTS AND NON-PAYMENT
5.1 If a payment is missed, the Company reserves the right to:
• Suspend access to online learning materials
• Restrict attendance at workshops or live sessions
• Pause marking of assessments
• Withhold certification
5.2 Payments outstanding for more than five (5) days may incur a £25 administration fee.
5.3 Where payment remains outstanding, the Company reserves the right to recover any outstanding balance through a debt recovery agency or legal proceedings.
5.4 The Learner agrees to reimburse any reasonable costs incurred in recovering unpaid fees.

  1. REFUNDS, CANCELLATIONS AND WITHDRAWALS
6.1 All deposits are strictly non-refundable.
6.2 All payments made towards a course are non-refundable except where required by law.
6.3 If a Learner chooses to withdraw from a course:
• No refund will be issued.
• Any remaining balance remains payable in full.
6.4 Failure to attend sessions does not constitute withdrawal and does not remove the obligation to pay the outstanding course balance.

  1. COURSE TRANSFERS AND DEFERRALS
7.1 Requests to transfer to a future cohort may be considered at the sole discretion of the Company.
7.2 Transfer requests must be submitted in writing.
7.3 An administration fee may apply.
7.4 Transfers are not guaranteed and are subject to course availability.
7.5 A maximum of one transfer may be permitted per enrolment unless otherwise agreed by the Company.

  1. COURSE DELIVERY
8.1 Courses may include:• Online learning
• Live online workshops
• In-person practical training
• Recorded content
• Assessments
• Case studies
• Mentoring and supervision
8.2 The Company reserves the right to:• Update course content
• Amend learning materials
• Change tutors
• Modify delivery methods
• Adjust course schedules where reasonably necessary
8.3 Such changes shall not constitute grounds for a refund.

  1. ATTENDANCE REQUIREMENTS
9.1 Learners are expected to attend all practical training days and live workshops wherever possible.
9.2 Minimum attendance requirements may apply to certification programmes.
9.3 Where attendance requirements are not met, additional mentoring, assessment or catch-up fees may be charged before certification can be awarded.

  1. COURSE ACCESS
10.1 Access to course materials will be provided for the period specified at enrolment.
10.2 Unless otherwise stated, access is typically available for up to twelve (12) months from the course start date.
10.3 Access periods may vary between programmes.

  1. CERTIFICATION
11.1 Certification will only be awarded when:
• All course fees have been paid in full
• All required coursework has been submitted
• All assessments have been successfully completed
• Any attendance requirements have been met
11.2 The Company reserves the right to withhold certification where these requirements have not been satisfied.
11.3 Certification issued by Equilibrium Pilates Education Limited confirms successful completion of the stated programme but does not guarantee employment, insurance eligibility or membership of any professional body.

  1. PROFESSIONAL RESPONSIBILITY
12.1 Learners must work within their own professional scope of practice at all times.
12.2 It remains the Learner's responsibility to ensure that any techniques, exercises or information taught are applied appropriately within their professional setting.
12.3 The Company accepts no liability for professional decisions made by Learners following completion of a course.

  1. PREREQUISITES
13.1 Learners are responsible for ensuring they meet all published prerequisites before enrolment.
13.2 The Company reserves the right to request evidence of qualifications, professional registration or prior learning where appropriate.

  1. INTELLECTUAL PROPERTY
14.1 All course materials remain the intellectual property of Equilibrium Pilates Education Limited.
14.2 Learners may not:
• Copy, reproduce or distribute materials
• Record training sessions without permission
• Upload course content to third-party platforms
• Use materials for commercial teaching purposes without written consent
14.3 Breach of intellectual property rights may result in removal from the course and legal action where appropriate.

  1. LIMITATION OF LIABILITY
15.1 Participation in practical training activities is undertaken at the Learner's own risk.
15.2 To the fullest extent permitted by law, the Company's liability shall be limited to the amount of fees paid for the relevant course.
15.3 The Company shall not be liable for:• Loss of earnings
• Loss of business opportunity
• Loss of professional income
• Travel or accommodation costs
• Indirect or consequential losses

  1. DATA PROTECTION
16.1 Personal information will be processed in accordance with UK GDPR and applicable data protection legislation.
16.2 Information will only be used for purposes connected with course administration, delivery and certification.

  1. FORCE MAJEURE
17.1 The Company shall not be liable for delays, interruptions or cancellations caused by circumstances beyond its reasonable control, including but not limited to:• Severe weather
• Natural disasters
• Government restrictions
• Public health emergencies
• Technology failures
• Tutor illness
17.2 Where possible, alternative arrangements will be provided.

  1. CANCELLATION BY THE COMPANY
18.1 The Company reserves the right to postpone or cancel a course.
18.2 In such circumstances, Learners will be offered either:
• A full refund of monies paid; or
• Transfer to a future cohort.

  1. GOVERNING LAW
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.

  1. ACCEPTANCE OF TERMS
By enrolling on any course delivered by Equilibrium Pilates Education Limited, you confirm that you have read, understood and agree to these Terms and Conditions.
